These Terms of Use ("Terms") govern your access to and use of the skarbix.io website (the "Site"), operated by AF Capital Inc. ("Skarbix", "we", "us", "our"). By accessing or using the Site, you agree to these Terms.
1. Nature of this website
This Site is an informational and lead-generation website describing the Skarbix digital asset settlement service. It does not provide self-service onboarding, does not accept digital assets directly, and does not constitute an offer to provide services in any jurisdiction where such an offer would be unlawful.
2. The Skarbix service
The Skarbix service — conversion of digital assets and settlement of proceeds to a third party on a client's behalf — is provided by AF Capital Inc. only pursuant to a signed Digital Asset Settlement Agreement and an accepted Payment Instruction Mandate. Nothing on this Site constitutes a binding offer of such services; services are only provided following our know-your-customer (KYC) and anti-money-laundering (AML) review, at our sole discretion.
3. Eligibility and own-initiative basis
By contacting us through this Site, you confirm that you are doing so on your own initiative. Where you are resident in the European Union or European Economic Area, you acknowledge that AF Capital Inc. is not soliciting, advertising, or marketing its services within the EU/EEA, and that any engagement results exclusively from your own initiative, consistent with Article 61 of Regulation (EU) 2023/1114 (MiCA).
4. No investment or financial advice
Content on this Site is provided for general informational purposes only and does not constitute investment, financial, tax, or legal advice. You should seek independent professional advice before making any decision related to digital assets or the transactions described on this Site.
5. Intellectual property
The Skarbix name, logo, and all content on this Site (text, graphics, design) are the property of AF Capital Inc. or its licensors and may not be copied, reproduced, or used without prior written consent, except as necessary to view the Site for its intended purpose.

This Site may link to third-party websites, including afxchange.com. We are not responsible for the content, accuracy, or practices of any third-party website.
7. Disclaimer of warranties
The Site is provided "as is" without warranties of any kind, express or implied, including as to accuracy, completeness, or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
8. Limitation of liability

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-laws principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada, without prejudice to any mandatory consumer-protection rights you may have under the law of your place of residence.

We may revise these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
